Lisa Johnson Photography Commercial Contract

By hiring Lisa Johnson Photography you are agreeing to the following:

Retainer. A $500 retainer is due at time of booking to secure the services from Lisa Johnson. This retainer is non-refundable.

Payment. The final payment will be due the day prior to the photo sessions commencing. No images or products shall be provided before payment is made in full. Due to the artistic nature of custom photography all sales are final.

Cancellation. If the session is cancelled by request of Client, the retainer will not be returned. If Client or Lisa Johnson requests to reschedule the session, Lisa Johnson and Client will make best efforts to find another suitable session date. The retainer will go towards the new session date.

Copyright. Lisa Johnson retains copyright ownership of all images. Lisa Johnson reserves the right to use the images for any purpose, including but not limited to advertising, publicity, promotions and web content.

Digital Images. High resolution, edited, digital images will be provided with no watermark. The photos provided are chosen by Lisa Johnson based on the shots that best represent the client, photographer's style, and the technical quality of the image. Unused/unedited images will not be released to Client for any reason.

Commercial Use License. Images are purchased by Client for Limited Commercial use only. This includes but not limited to, advertising, marketing, website usage and social media platforms owned or managed by the Client. The Client may not alter or edit the images. Exceptions to alterations include, company name, logo or text related to the company and for advertisement purposes. Only the Client can use the images provided by Lisa Johnson and Client may not resell, loan or allot images to a third party.

Print Release. Lisa Johnson grants permission to Client to make an unlimited number of prints of the images provided for Commercial use. It is recommended, but not required, to get prints done through Lisa Johnson Photography's affiliated professional lab. Client is free to print photos wherever they choose. Lisa Johnson is not responsible for printing errors or for quality of prints or products.

Failure to Perform. If Lisa Johnson cannot perform this Agreement due to a fire or other casualty, injury, illness or other cause beyond the control of the parties, then Lisa Johnson shall return payment to Client but shall have no further liability with respect to this contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, or otherwise lost or damaged without fault on the part of the photographer. The Client releases Lisa Johnson from all liabilities, injuries, claims and damages that may result from any accidents or incidents that may happen during the session.

Archive. All session photos will be archived after 2 months of becoming available for download. An unarchiving fee of $30 will be incurred if Client requires access to these photos after this time, if they are still available.
